A federal judge lifted the final suspension that prevented the authorities from apprehending the former director of Pemex, Emilio Lozoya Austin, who is going through a process for money laundering and his alleged participation in the Odebrecht case.
The Eighth District Judge of Amparo in Criminal Matters took the decision after the former federal official failed to comply with each of the conditions that were imposed to preserve the protection that was granted on June 5 to prevent his detention. The conditions of his protection consisted in that in a lapse of three working days he had to appear before the control judge of the North Prison, to go before the judge of protection to sign the days Monday in a schedule of 10:00 to 14:00 hours and exhibit a guarantee for 500 thousand pesos. None of these conditions were met by the former director of PEMEX.
This suspension of the protection puts Lozoya as a fugitive from justice.
On June 10, Emilio Lozoya publicly informed that he would not appear before the control judge, arguing that the conditions did not exist to ensure that he was not apprehended in an irregular manner.
"Whenever the complainant (...) failed to comply with all the postulates imposed by this federal court (...) the final suspension granted is rendered null and void", sentenced Judge Luisa María Ortega Tlapa.
Despite the withdrawal of the final suspension, Lozoya's application for protection continues and will be in a constitutional hearing in which it is decided whether or not to grant the appeal requested by the former director, although this time as a fugitive.
