The Committee against Forced Disappearance of the United Nations Organization ruled on the intention of the National Human Rights Commission (CNDH) to close the case of Daniel Ramos Alfaro.

The UN Committee concerns about the way in which the CNDH has investigated the human rights violations committed against Daniel Ramos Alfaro.

Mexico City on October 14, 2019. In the context of Urgent Action 10/2013 issued at the end of 2013, due to the disappearance of Daniel Ramos Alfaro, the United Nations Organization's Committee on Forced Disappearance indicated that it is concerned about the apparent intention of the National Human Rights Commission to formulate a draft non-responsibility agreement for human rights violations against Daniel Ramos Alfaro, as well as the deficiencies in the investigation carried out by the CNDH.

Daniel Ramos Alfaro was a volunteer instructor at the National Council for Educational Development (CONAFE) in the State of Michoacán. On October 2, 2013, Daniel Ramos disappeared somewhere between the towns of Betania and Nuevo San Martín.

The evidence suggests that the Mexican Army participated in these events. More than five years after his disappearance, the Mexican State has not been able to clarify Daniel's destiny and has failed to bring justice to any of the perpetrators.

Due to Daniel's disappearance, a complaint file was initiated in the National Human Rights Commission, which tried to be closed by said National Commission. After years of uncertainty, personnel of that Public Organization summoned the representatives of Daniel Ramos to a meeting, where the CNDH informed that they were about to close the investigation of the case.

At the same time, this institution made known the representation of Daniel that his investigation had been limited to the reading of the file that works in the Attorney General's Office for the disappearance of Daniel, and that the only authority investigated was the Secretariat of National Defense, despite the fact that the CMDPDH had requested the CNDH to investigate all the authorities involved.

Faced with the lack of will, and the evident intention of closing the file with a no-liability agreement, this Mexican Commission requested the Committee against Enforced Disappearances to require additional information from the Mexican State, and to adopt precautionary measures to avoid damage to the rights to memory, truth, justice, and reparation of Daniel Ramos Alfaro and his family.

Accordingly, on September 24, 2019, the Committee against Enforced Disappearances of the United Nations Organization, in the framework of the Urgent Action issued in the case of Daniel Ramos, required the Mexican State:

"Ensure that any decision to close the file of the investigation of the disappearance of Mr. Daniel Ramos Alfaro by the National Commission of Human Rights is taken only after having exhausted the analysis of all the attainable information and the investigation of all possible hypotheses ”.
